1. Service Description

SendTheEstimate provides professional estimate and invoice PDF generation services for contractors and tradespeople. We generate branded, itemized proposals and invoices from information you submit through our platform.

2. Acceptance of Terms

By accessing or using SendTheEstimate, you agree to be bound by these Terms of Service. If you do not agree, you must not use the service.

3. User Responsibilities

You are responsible for the accuracy, completeness, and legality of the information you submit. Estimates and invoices generated through our service are provided as tools for your use with your customers. You are solely responsible for the content of your estimates and invoices and any representations made therein.

4. Payments & Subscriptions

Payments are processed through Stripe, our third-party payment processor. Subscription plans renew monthly unless cancelled before the renewal date. Payments are non-refundable once an estimate or invoice PDF has been generated and delivered. You may cancel your subscription at any time through your dashboard; cancellation takes effect at the end of the current billing period.

6. Data Retention

Completed estimate and invoice PDF files are automatically purged after 90 days. Submission data is encrypted at rest using AES-256 encryption. You may request deletion of your data at any time by contacting us.

7. Limitation of Liability

SendTheEstimate is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall SendTheEstimate, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to loss of revenue, loss of profits, loss of business, or loss of data, even if advised of the possibility of such damages. Our total liability for any claim arising from or related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

We do not guarantee that estimates or invoices generated by the service will be free from errors. We do not provide legal, financial, or tax advice. You should consult appropriate professionals for guidance on pricing, tax calculations, licensing requirements, and contractual obligations in your jurisdiction.

9. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law provisions.
